Refund, Return and Warranty Policy - Furzo
Preamble: Furzo's role and policy application
Furzo is an online platform facilitating contact between independent sellers (hereinafter the «Sellers») and customers (hereinafter the «Buyers»).
Default Policy vs. Seller's Policy : This policy defines the return, refund and warranty conditions applicable by default to all transactions on Furzo. However, each Seller has the possibility to define and display its own policies. (warranty, return, refund) on its product pages or store.
Primacy of Vendor Policies : If a Seller has defined its own policies, these prevailing on Furzo's default policy, subject to compliance with minimum legal requirements.
Buyer's liability : Buyers are strongly encouraged to carefully consult the Seller's specific policies before finalizing any purchase.
Legal obligations : Certain warranties and rights are imposed by law (particularly for European consumers) and cannot be restricted by Seller or Furzo policies. These legal rights will always apply in the event of a dispute, even if a specific policy attempts to limit them.
1. Inalienable legal rights (EU/France consumers)
In accordance with current legislation, in particular for Buyers residing in the European Union, the following rights are guaranteed and cannot be modified by the Sellers:
Right of withdrawal : Consumer Buyers have a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to justify their reasons or pay any penalties. To exercise this right, the Buyer must notify the Seller of his/her decision to withdraw (via the Furzo messaging system). The product must be returned to the Seller within 14 days of this notification. Direct return costs are generally borne by the Buyer, unless the Seller agrees to bear them or has not informed the Buyer of this cost. The full refund (product price and standard initial delivery charges) will be made by the Seller upon receipt of the returned product or proof of shipment. This right does not apply to certain goods (personalized products, perishable goods, digital content not supplied on a physical medium whose execution has begun, etc.).
Garantie Légale de Conformité : Products sold are covered by the legal guarantee of conformity (articles L. 217-4 et seq. of the French Consumer Code). If a product has a conformity defect existing at the time of delivery, the Buyer has the right to two years from the date of delivery of the good to take action. He may choose between repair or replacement of the good, subject to the cost conditions provided for by law. If repair or replacement is impossible, the Buyer may return the good and have the price refunded, or keep the good and have part of the price refunded. During the 24 months following delivery (6 months for second-hand goods), the Buyer is exempted from proving the existence of the lack of conformity.
Legal warranty against hidden defects : The Buyer also benefits from the legal warranty against hidden defects (articles 1641 et seq. of the French Civil Code), which would render the product unfit for its intended use. The Buyer may choose between cancellation of the sale or a reduction in the purchase price.
2. Furzo Standard Warranty Policy (Applicable by default)
Duration : In the absence of a specific warranty policy defined by the Vendor, each product is covered by a warranty. default 30-day commercial warranty from the date of receipt by the Buyer.
Cover : This warranty covers manufacturing defects and conformity problems not related to normal wear and tear or misuse. It does not cover accidental damage, normal wear and tear, damage caused by misuse, or modifications made by the Buyer.
Procedure: In the event of a problem covered by this warranty, the Buyer must contact the Seller via Furzo's internal messaging system within 30 days of receipt to discuss a solution (exchange, repair, partial or total refund).
Note: This commercial warranty is in addition to and does not replace the legal warranties mentioned in point 1.
3. Furzo Standard Redemption Policy (Applicable by default)
Non-Expedited : If a Seller has not shipped the order within one (1) year from the date of purchase, the Buyer is entitled to request a full refund. The Seller shall then make the refund unconditionally via the Furzo platform. (Note: This delay is exceptionally long. Sellers are advised to ship much faster).
Problems at Reception : For products not received (after a reasonable shipping delay), not conforming to the description, or arriving damaged, the Buyer must contact the Seller via the Furzo messaging system as soon as possible, ideally within 14 days of the planned or actual delivery date.
Resolution: The Seller and the Buyer are encouraged to find an amicable solution (return, partial or total refund).
4. Furzo Standard Return Policy (Applicable by default)
Report : In the absence of a specific return policy from the Seller, and apart from the legal right of withdrawal, the Buyer has the following options 14 days from receipt of the product to notify the Seller (via the Furzo messaging system) of a problem justifying a return (e.g. defective product not covered by the immediate legal warranty of conformity, ordering error not attributable to the Buyer).
Product condition : Returned products must be in their original condition, unused (except to ascertain the defect), complete and, if possible, in their original packaging.
Return shipping : Unless otherwise specified in the Seller's policy or by mutual agreement, return costs for reasons other than the exercise of the right of withdrawal or legal guarantees may be borne by the Buyer. It is advisable to clarify this point with the Seller prior to the return.
5. Vendor-specific policies
Flexibility : Each Seller may define its own warranty (duration, coverage), return (notification period, conditions, fees) and refund policies, which will be displayed on its product pages or store.
Limitations: These specific policies in no way diminish the legal rights of our customers. of the Buyer (right of withdrawal, legal warranties of conformity and hidden defects). Any clause to the contrary shall be deemed unwritten in the event of a dispute.
Consultation : It is imperative that the Buyer read and understand the Seller's policies prior to purchase.
6. International sales (excluding France/EU)
Shipping : Sellers may choose whether or not to ship internationally. If the delivery address is outside the EU and the Seller decides not to ship (for reasons of cost, customs, logistics), he may cancel the order and the Buyer will receive a full refund.
Additional fees : For deliveries outside the EU, customs duties, import taxes and clearance charges may be levied by the authorities of the destination country. These charges are to be borne exclusively by the Buyer and are not included in the price paid on Furzo. It is the Buyer's responsibility to inquire about these possible costs before ordering.
7. Furzo Assistance and Mediation
Communication : Furzo's internal messaging system is the preferred tool for any communication between Buyer and Seller concerning an order, a return or a refund.
Mediation : In the event of a persistent disagreement between a Seller and a Buyer, and after an attempt at direct amicable resolution, the Furzo support team may be asked to act as mediator. Furzo will endeavor to propose an equitable solution, based on applicable policies (those of the Seller or Furzo's default policies) and respect for legal rights.
8. Important exclusions
Communication channel : Only transactions carried out and communications exchanged directly via the Furzo platform (orders, payments, internal messaging) are covered by these policies and any mediation by Furzo.
External transactions : Any negotiation, agreement, payment or return managed outside the Furzo platform (e.g. via social networks, external messaging, links to other sites not integrated into the Furzo order). does not engage the responsibility of Furzo and is not covered by these policies. Products that simply redirect to an external site without a transaction on Furzo are not covered by this Furzo return policy.
