General Sales Conditions (GSC) - Customers

Article 1 - Purpose

These General Terms and Conditions of Sale (GTCS) govern the relationship between Furzo, a platform that brings together artists and buyers of furry products, and customers using the platform to make purchases.

Article 2 - Definitions

Furzo furry: The platform that brings together artists and buyers of furry products, accessible at https://furzo-marketplace.com/.
Customer Any individual or legal entity using the Furzo platform to purchase products.
Artist Any individual or legal entity using the Furzo platform to sell products.
Product Any good or service offered for sale on Furzo by an artist.
Control Act by which the customer undertakes to purchase a product via Furzo.

Article 3 - Acceptance of the GCS

Any order on the Furzo platform implies unreserved acceptance of these GTC.

Article 4 - Products

The products offered on Furzo are artistic services (creation of works to order) or cultural and artistic goods (prints, goodies, digital files).
Furzo acts as a technical intermediary, bringing the artists together and securing the financial transaction linked to this artistic mandate.

Article 5 - Ordering

Customers can place orders by following the instructions on the platform.
An order is definitive once full payment has been received.
For technical and transaction security reasons, only one «Commission» product can be added to the basket at a time, and it cannot be combined with other classic products in the same order.

5.1 Validation by the Artist for personalized products

Once payment has been made by the Customer, the order is placed on hold pending validation. The Artist has 6 days to accept the order.
If the artist accepts : The order goes into «Processing» status and production begins.
If the Artist refuses or does not reply within 6 days: the order is automatically cancelled and the Customer is refunded in full, free of charge.

Article 6 - Prices

Prices are shown in euros, inclusive of all taxes.
Delivery costs are specified before the order is validated.

Article 7 - Payment

Orders can be paid for by credit card (via Stripe).

7.1 Escrow of funds

Payment for orders is made by credit card via the secure service provider Stripe. Payment for orders is made by credit card via the approved payment service provider Stripe. Stripe ensures the security of the funds and acts as a third-party trustee. When a product is paid for, the amount is debited to the customer and held securely by Stripe. Furzo simply sends Stripe the technical instruction to release the funds to the Seller once the order has been marked as «Completed».

7.2 Price adjustment

During the order process (particularly for personalized orders), the initial price may change in agreement with the customer:

Surcharges : If the final price defined by the Artist is higher than the initial bank imprint, the initial payment is cancelled and a new payment request with the new amount is sent to the Customer.
Partial refunds: If the service is reduced or partially cancelled by mutual agreement, a partial refund will be credited to the customer's original means of payment.

Article 8 - Delivery and shipping via Furzo

8.1. Shipping terms The Furzo platform facilitates the management of shipments by providing Artists (Sellers) with prepaid shipping labels. However, the Artist remains solely responsible for the physical preparation of the parcel, its packaging and delivery to the carrier.

8.2. Cost and delivery charges Shipping costs are calculated automatically when the order is placed, based on the weight and dimensions declared by the Artist, and include the cost of the carrier, platform management fees and, where applicable, insurance. ad valorem for orders over €150.

8.3. Delivery times (Manufacturing + Transport) The total delivery time comprises two distinct phases:

Manufacturing and processing time : For products in stock, shipping generally takes 48 to 72 hours. For customized orders (commissions), In the event of an accident, the Customer must refer to the manufacturing lead time specifically indicated by the Artist on the product sheet or in his own Terms of Sale. The Artist is solely responsible for respecting this lead time.
Delivery time : Once the product has been completed and the order status has been changed to «Delivery», the carrier's delivery times apply (generally 3 to 5 working days, depending on the service chosen).

8.4. Obligation to ship Once the order is ready and the shipping label has been generated by the Artist, the latter has a maximum period of 7 calendar days to give the parcel to the carrier. Furzo cannot be held responsible for any delays due to the Artist's production or to the hazards of transport.

8.5. Follow-up and acceptance The Customer will receive a tracking number as soon as the parcel is picked up by the transport network. In the event of a damaged parcel on receipt, the Customer must make written reservations with the carrier or refuse the parcel, and inform the Artist via the internal messaging system within 48 hours to enable an insurance claim to be made.

8.6 Order completion (Release of funds) For physical products, the order is considered completed upon confirmed receipt or after the shipping deadline. For digital services and commissions, the Artist marks the order as «Completed» once the files have been delivered. This action triggers the release of the escrowed funds to the Artist's account. In the event of proven non-delivery, the Customer may report the dispute to Furzo to obtain reimbursement of the escrowed funds.

Article 9 - Withdrawal

In accordance with the law, the customer has fourteen (14) days from receipt to exercise his right of withdrawal without reason or penalty.

Notification to the artist in writing (email or post).
Return of the product in its original packaging, in perfect condition, within 14 days of retraction. Return shipping costs are at the customer's expense.
The artist will reimburse within 14 days of receipt of the returned product.

IMPORTANT EXCEPTION - Custom orders and Digital Content : In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal CANNOT be exercised for :

Products made to the consumer's specifications or clearly personalized (e.g. artistic commissions, personalized badges, YCH).
The supply of digital content not provided on a tangible medium (immediate download), the performance of which has begun after prior agreement by the consumer and express waiver of his right of withdrawal.

By validating a «Commission» or «Digital Download» order, the Customer expressly waives his/her right of withdrawal once the Artist has begun work or the file has been downloaded.

Article 10 - Legal warranties

The customer benefits from the legal guarantees of conformity and against hidden defects, valid for two years:

Warranty of conformity Product does not conform to description or reasonable expectations.
Warranty against hidden defects Pre-existing, non-visible defect rendering the product unfit for its intended use. In the event of a problem, the customer must contact the artist for an amicable solution (repair, replacement, refund).

Article 11 - Settlement of disputes

The parties agree to seek an amicable solution via Furzo's internal messaging system.
If no agreement is reached, Furzo may be called in to examine the exchanges on the platform and attempt to find a fair solution.

Article 12 - Responsibility of Furzo

Furzo is an intermediary and not a party to sales contracts. Furzo's liability is limited:

Platform reliability.
At the amount of commissions received for the transactions concerned, or at the pro rata of the subscription taken out for artists benefiting from a commission-free offer.
Delayed or non-delivery.
Non-conforming products.
Technical problems or external disputes.

Article 13 - Intellectual property

The contents of Furzo (logo, texts, images, etc.) are protected. Any reproduction or modification is forbidden without prior authorization.

Article 14 - Personal data

Furzo collects and processes personal data in compliance with the RGPD :

Purpose: Account creation, order management, communication.
Rights: Access, rectification, deletion, limitation. Contact Furzo to exercise these rights.

Article 15 - Applicable law and jurisdiction

The GCS are governed by French law. The French courts have exclusive jurisdiction in the event of a dispute.

Article 16 - Duration and amendments

The GTC come into force on February 1st 2024 for an indefinite period.
Furzo reserves the right to modify them. Customers will be informed by email or notification.

Article 17 - Notifications

Customers should check the GTC regularly for changes. Notifications sent by email or on the Furzo platform.

Article 18 - External links and affiliation products

Furzo may authorize artists to offer «external products/affiliations» on the platform. These products are sold outside Furzo, and the artist redirects customers to an external website to complete the purchase.

Furzo is not responsible for the content, products, services or practices of external web sites to which artists may redirect customers.

The purchase of external products/affiliations is the sole responsibility of the customer and the artist concerned. Furzo cannot be held responsible in the event of litigation, payment problems, delivery or product non-conformity.

It is the customer's responsibility to check the terms and conditions and privacy policy of the external website before making a purchase.
