Furzo Terms of Use (TOU)

  1. Subject

These Terms and Conditions of Use (TCU) set forth the terms under which users (Buyers and Sellers) may use the Furzo platform to buy and sell products and services.

  1. Accessing the Site and Creating an Account

Access to Furzo is restricted to individuals aged 13 and older. However, NSFW content is strictly reserved for users who are of legal age (18 or older). Users must provide their date of birth during registration and certify that the information provided is accurate.

Required information for creating an account:

  • Buyer: Email address, date of birth, phone number (for verification via OTP code).
  • Seller: Last name, first name, phone number, store name, email address, date of birth, phone number (for verification via OTP code).

A valid phone number is required to create an account. A one-time verification code (OTP) will be sent to this number when you log in for the first time to verify your account. Each phone number can only be used once.

Furzo We do not deny access to anyone; however, in the event of fraud, attempted fraud, or a violation of the Terms of Use or Terms and Conditions, the user may be barred from accessing the website via an IP ban or phone number ban.

In the event of a false statement regarding age or any other information, Furzo reserves the right to suspend or delete the account. Minors may not create a seller account and may not access products marked as NSFW.

  1. Terms of Use for the Website

Users agree to use Furzo in accordance with applicable laws.

In addition to the general terms of use set forth in the Terms of Service, users of Furzo agree not to:

      • Illegal or harmful content:
        • Distribute, publish, or promote content (text, images, videos, etc.) that is illegal, defamatory, obscene, hateful, threatening, violent, incites discrimination or racial hatred, is xenophobic or homophobic, or infringes on the privacy of others.
        • Glorifying crimes or offenses, or inciting others to commit such acts.
        • Promoting or facilitating illegal activities (sale of counterfeit goods, drugs, weapons, etc.).
      • Infringement of intellectual property rights:
        • To infringe or violate copyrights, trademarks, patents, or any other intellectual property rights.
        • Using copyrighted works without permission.
      • Harassment and Intimidation:
        • Harceler, intimider, menacer ou insulter d’autres utilisateurs.
        • Adopter un comportement irrespectueux ou abusif.
      • Identity theft:
        • To impersonate another person or entity.
        • Using another person's account without permission.
      • Spam and unauthorized commercial activities:
        • Sending unsolicited messages for commercial purposes (spam).
        • Collecting email addresses or other personal information for commercial purposes without consent.
      • Tampering with and disrupting the platform:
        • Attempting to harm the Furzo platform, its servers, or its network.

        • Interfere with the proper functioning of the platform or disrupt the experience of other users.

Mature and Artistic Content (18+):

Furzo permits the sale of artistic works and products intended for a discerning adult audience (hereinafter “Mature Content”). This content is permitted only if strict presentation requirements are met

        • General Audience Showcase: No explicit nudity, genitalia, or sexual acts may be visible in cover images (thumbnails) or banners. The Seller must use censorship techniques (blurring, cropping, masking) for all public content.
        • Categorization: The product must be identified using the “Mature” option or tag (formerly known as NSFW) when it is created.
        • Nature of the product: The sale of illegal pornography (child pornography, depictions of real violence, realistic bestiality) is strictly prohibited and will be immediately reported to the authorities.

Are strictly prohibited on the platform, any content or products defined as “illegal pornography” or material designed to its primary and obvious purpose is sexual gratification.

This includes, in particular:

  1. Real-Life Videos and Photos: Any content depicting real people engaged in explicit sexual acts.

  2. Obscene material with no artistic merit: Content that lacks any narrative, aesthetic, or humorous context and is intended solely to elicit immediate sexual arousal.

  3. Sexual services: Prostitution, escort services, or sexual dating services.

Adult content permitted on Furzo must be part of an approach artistic, creative, narrative, or character design. The artists guarantee that their works are works of fiction, illustrations, or collectibles/decorative items, and not pornographic materials intended to satisfy sexual desires as defined by current banking regulations.

If the rules are not followed, the product will be removed and the seller will be penalized.

Penalties for noncompliance:

Penalties are imposed based on the severity of the violation and may include the following, in this order:

  • Disclaimer
  • Product Removal + Warning
  • Temporary Deactivation of the Seller Account
  • Seller Account Deactivation for an Indefinite Period
  • Account Deletion or IP Ban (Blocked from Accessing the Site)
  • Reporting to the appropriate authorities, if necessary
  1. Intellectual Property

Sellers must ensure that they own the rights to the products or services they offer or that they have explicit authorization to do so. Furzo is not liable for any infringement of copyright or intellectual property rights.

Furzo reserves the right to remove any content that infringes on the intellectual property rights of third parties.

  1. Sellers' Obligations

  • Sellers must configure the VAT settings for their products if they are subject to this tax. It is their responsibility to comply with applicable tax laws.
  • Sellers who generate regular income or significant amounts of revenue must register as a micro-enterprise or adopt a legal status appropriate to their business.
  • Sellers must tag a product as NSFW if it contains adult content.
  • Sellers must deliver the products or complete custom orders (commissions) within a maximum of one year.
  • For custom orders, Sellers must obtain the Buyer’s explicit approval before completing the order.
  • A Seller may refund a Buyer at any time to terminate a sales contract.
  • Sellers must comply with the Terms and Conditions regarding commissions.
  • Physical shipments are limited to the geographic areas covered by our logistics partner, Boxtal (excluding, in particular, the United States). The Seller may cancel and refund any order with a delivery address outside this area
  • Sellers must respond to messages from buyers within 48 hours, unless they are experiencing personal difficulties or are on vacation.
  • Sellers may advertise and sell products outside of Furzo.

Furzo ensures that adult content is not accessible to minors by blocking access to minors and guests.

5.1 Commission and Customized Product
  • Order Acceptance (6-day period): The Seller has a mandatory period of 6 days (144 hours) from the time the order is notified to accept it (status “In Progress”). After this period, the order will be automatically canceled by the system, and the Buyer’s credit card hold will be released without any charges (no funds will be debited). The Seller acknowledges that no compensation may be claimed in the event of cancellation due to lack of response.
  • Trusted Third-Party System: The Seller agrees that the funds paid by the Buyer will be held in escrow by Furzo (via Stripe) and will not be released to the Seller’s virtual wallet until the order is marked as “Completed.”
  • Transaction Fees and Dynamic Adjustments: The transaction fees charged by the payment service provider (Stripe) are entirely the responsibility of the Seller. These fees are calculated based on actual costs. If the price of an order changes during processing (e.g., an additional charge to the buyer or a partial refund), the Stripe fees will be automatically adjusted.

SHIPPING POLICY AND LOGISTICS MANDATE

Use of Furzo’s automated tagging system implies full and unconditional acceptance of the following rules.

1. Shipping Order

Furzo provides the Seller with a technical solution that facilitates the purchase of shipping labels through its logistics partner (Boxtal). Although Furzo technically settles the invoice with the carrier, Furzo acts solely as a technical intermediary purchasing the shipping label in the name and on behalf of the Seller (transparent mandate). The shipping contract, as well as liability for the goods, is exclusively between the Seller (the actual shipper) and the carrier. Under no circumstances may Furzo be held liable for the loss, theft, delay, or damage to the package during transit. In the event of an incident, Furzo will assist the Seller by filing a claim with the carrier, but any refund for the order will depend exclusively on the compensation approved by the carrier or its insurance company.

2. Responsibility for Declarations (Weight and Dimensions)

The Seller is solely responsible the accuracy of the information provided regarding the weight and dimensions of their packaged items. The Seller agrees to weigh their product once packaged before filling out the product information form or confirming shipment.

3. Offset Clause and Re-billing of Variances (Adjustment)

If a carrier inspection reveals a discrepancy between the weight or size declared by the Seller and the actual weight or size (e.g., a package declared as 1 kg but weighed at 3 kg by the carrier), the carrier will charge Furzo a “surcharge” or penalty.

The Seller expressly authorizes Furzo to:

  1. Pass on the full amount of this financial adjustment to the Seller.
  2. Process an immediate settlement by deducting this amount from the available balance in the Seller's virtual wallet (Wallet).
  3. If the balance is insufficient, seek reimbursement through any legal means. An adjustment invoice will be issued and made available to the Seller.

4. Packaging Requirements and Insurance

For orders over €150, Furzo automatically purchases insurance (such as AXA through Boxtal) for the transaction. However, this insurance does not cover damage resulting from insufficient or inappropriate packaging. The Seller agrees to strictly comply with the carriers’ packaging specifications (sturdy cardboard box, internal padding, legible label).

  • If the insurance company denies a claim due to non-compliant packaging, the Seller bears full financial responsibility and must reimburse the Buyer.

5. Submission Deadline and Status Update

The Seller agrees to meet the production/creation timeframe stated on its product page. Once the product is complete, the Seller must generate the label through the system. The Seller then has a strict deadline of 7 calendar days to drop off the package at a pickup location or post office. After this time:

  • The label may be expired, and the package may be refused.
  • Furzo reserves the right to cancel the order and refund the Buyer. The cost of the unused shipping label may remain the Seller’s responsibility if a refund from the carrier is no longer possible.

6. Gestion des Litiges Transport

In the event of loss or damage, the Seller must notify Furzo via the support system as soon as possible. Furzo, as the holder of the carrier account, will handle the filing of the claim. The Seller agrees to provide all necessary evidence (original invoice, photos of the package, sworn statement) within 48 hours. Any failure by the Seller to cooperate that results in the claim being denied will preclude any compensation.

  1. Report Management

Reports may concern users or products.

To report a product, click “Report this product” on the product page.

If a product is reported as violating the Terms of Service:

  • The product will be discontinued.
  • The seller will receive a warning.

Multiple warnings may result in the Seller being banned. The Seller's information (last name, first name, store) will be added to a blacklist.

Furzo reviews reports based solely on information available within the platform (messaging, emails, order notes).

Processing times for reports:

Reports are reviewed within 48 hours. However, it may take longer to resolve the report. While the report is being processed, depending on its severity, the seller's account may be deactivated.

Appeals of Decisions:

Users can appeal a decision made in response to a report by contacting Furzo.

  1. Collection and Protection of Personal Data

The data is stored on Hostinger's FTP server, which is protected by multi-factor authentication.

Users may request access to, modification of, or deletion of their data at any time by contacting Furzo via email or the contact form.

  1. User Reviews

Reviews are collected publicly and managed automatically by Furzo.

Only buyers who have placed an order for this product can leave a review.

Fraudulent or offensive reviews will be removed, and the Buyer at fault will receive a warning. Fake or malicious reviews are not permitted, and the Buyer at fault will receive a warning.

Furzo reserves the right to moderate, edit, or delete comments if they are not constructive or are abusive.

  1. Limitation of Liability

Furzo acts solely as a technical intermediary. As such, Furzo cannot be held liable for:

  • Disputes arising between Buyers and Sellers (particularly regarding production times for custom orders).
  • Issues related to the transportation process (delays, strikes, losses caused by the carrier), unless it is proven that Furzo was at fault in generating the label.
  • Tax or customs assessments resulting from an incorrect declaration by the Seller.
  • The insurer’s refusal to pay compensation in the event that the packaging is deemed noncompliant.
  1. Payment

The payment method accepted and managed on Furzo is Stripe. Furzo acts as a trusted third party: funds are secured until the transaction is finalized. Sellers must link their Stripe account or add their bank information in their dashboard to receive transfers once the funds are released.

  1. Changes to the Terms of Service

Furzo reserves the right to modify these Terms of Use at any time. In the event of significant changes, users will be notified via a notice on the website or by email. The notification will be posted within the same day. Continued use of the website after the Terms of Use have been modified constitutes acceptance of the new provisions.

  1. Governing Law

These Terms of Use are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution before pursuing legal action. If the Buyer and Seller are unable to reach an amicable resolution, Furzo acts neither as a judge nor as an arbitrator and does not, under any circumstances, evaluate the artistic quality of a work. Furzo acts solely as a technical facilitator. As such, Furzo may technically enforce the cancellation and refund of an order via the Stripe API solely on the basis of factual and objective criteria (e.g., proven non-delivery with tracking information as proof, complete lack of response from the seller within the specified time frame, proven fraud, or a “ghost” seller).
